{"id":440,"date":"2018-11-25T10:28:49","date_gmt":"2018-11-25T08:28:49","guid":{"rendered":"http:\/\/yavuzalogan.com\/?p=440"},"modified":"2020-07-21T10:30:39","modified_gmt":"2020-07-21T08:30:39","slug":"anayasa-iskilipli-atif-ve-fasulye","status":"publish","type":"post","link":"http:\/\/yavuzalogan.com\/?p=440","title":{"rendered":"ANAYASA, \u0130SK\u0130L\u0130PL\u0130 \u00c2TIF VE FASULYE"},"content":{"rendered":"\n<p>Yavuz Alogan<\/p>\n\n\n\n<p>Laiklik kar\u015f\u0131t\u0131 uygulamalara yasall\u0131k kazand\u0131racak bir Anayasa de\u011fi\u015fikli\u011finin yap\u0131lmas\u0131, mevcut yasalar\u0131n bu de\u011fi\u015fikli\u011fe uygun bi\u00e7imde yeniden d\u00fczenlenmesi gerekmez mi?<\/p>\n\n\n\n<p>Anayasa\u2019da yer alan \u00fcnl\u00fc ifade \u015fu \u015fekilde de\u011fi\u015ftirilebilir: \u201cT\u00fcrkiye laik olmayan bir sosyal hukuk devletidir.\u201d&nbsp; Ya da daha samimi bir ifade: \u201cT\u00fcrkiye ne laik ne de sosyal bir hukuk devletidir.\u201d Ya da&nbsp; \u201cBir hukuk devleti olmayan T\u00fcrkiye laik ve sosyal de\u011fildir.\u201d Bo\u015fluklar\u0131 herkesin kafas\u0131na g\u00f6re doldurabilece\u011fi \u015fu k\u0131sa ifade mevcut durumu belki daha iyi yans\u0131t\u0131r: \u201cT\u00fcrkiye bir devlettir.\u201d<\/p>\n\n\n\n<p>Ya da heybetli bir ifade: \u201cT\u00fcrkiye mill\u00ee \u015fuur ve \u00fclk\u00fcleri Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan belirlenen, tasada ve k\u0131van\u00e7ta ortak olan Reis ve dan\u0131\u015fmanlar\u0131n\u0131n anayasa yapt\u0131\u011f\u0131 ve kanun \u00e7\u0131kard\u0131\u011f\u0131, laik ve sosyal olmayan bir fakir fukara garip guraba devletidir.\u201d<\/p>\n\n\n\n<p>B\u00f6yle bir de\u011fi\u015fiklik anayasan\u0131n samimiyet ilkesine uygun d\u00fc\u015fer ve bizim gibi yurtta\u015flar\u0131n kendilerini enayi gibi hissetmelerini \u00f6nler.<\/p>\n\n\n\n<p>Bende san\u0131r\u0131m bir t\u00fcr b\u00fct\u00fcnsellik ve tutarl\u0131l\u0131k saplant\u0131s\u0131 var, \u00fczerinize afiyet&#8230; \u0130nsan\u0131n yalan s\u00f6ylememesi, yasalar\u0131n ger\u00e7ek hayatla uyum i\u00e7inde olmas\u0131, g\u00f6r\u00fcnt\u00fcyle ger\u00e7e\u011fin \u00f6rt\u00fc\u015fmesi bence \u00e7ok \u00f6nemli. Abart\u0131yor da olabilirim.<\/p>\n\n\n\n<p>Fakat b\u00fct\u00fcn bunlar\u0131 Say\u0131n Diyanet \u0130\u015fleri Ba\u015fkan\u0131\u2019n\u0131n \u0130skilipli \u00c2t\u0131f\u2019\u0131n resmi \u00f6n\u00fcnde ge\u00e7en sene yapt\u0131\u011f\u0131 bir konu\u015fmay\u0131 izlerken d\u00fc\u015f\u00fcnd\u00fcm. Karadeniz\u2019in bir da\u011f k\u00f6y\u00fcnde jandarma g\u00f6rmesin diye Kur\u00e2n\u2019\u0131 ta\u015f duvardaki kovuklara nas\u0131l saklad\u0131klar\u0131n\u0131, \u201cAman Yarabbi!\u201d diyerek anlat\u0131yordu.&nbsp; Say\u0131n Cumhurba\u015fkan\u0131 da ge\u00e7enlerde Mevlid-i Nebi Haftas\u0131 m\u00fcnasebetiyle nutuk s\u00f6ylerken, \u201cAllah Allah nidalar\u0131yla vatanla\u015ft\u0131r\u0131lan bir \u00fclkenin camileri, minareleri tam 18 y\u0131l boyunca ezan-\u0131 muhammediye hasret b\u0131rak\u0131lm\u0131\u015ft\u0131r\u201d \u015feklinde bir ifade kulland\u0131lar.&nbsp; \u0130nsan \u015f\u00fcpheye d\u00fc\u015f\u00fcyor. Acaba biz ayn\u0131 \u00fclkede ya\u015famad\u0131k m\u0131? M\u00fcsl\u00fcmanlar\u0131 gettolara m\u0131 kapatm\u0131\u015flard\u0131?<\/p>\n\n\n\n<p>Say\u0131n Diyanet Ba\u015fkan\u0131, konu\u015fmas\u0131n\u0131n devam\u0131nda, \u201c\u015eu anda bizim 4 ya\u015f\u0131nda, 5 ya\u015f\u0131nda, 6 ya\u015f\u0131nda, \u00fclkemizde 50 bine yakla\u015ft\u0131 \u00f6\u011frenci say\u0131m\u0131z (var), resm\u00ee, kay\u0131tl\u0131\u201d dedikten sonra, \u015f\u00f6yle ifade buyuruyorlar: \u201cHer mahallede \u2026 S\u0131byan Mektepleri\u2019ni ihya edelim yeniden. Bu f\u0131rsat\u0131 iyi de\u011ferlendirelim.\u201d<\/p>\n\n\n\n<p>F\u0131rsat\u0131 de\u011ferlendirerek zamana oynama stratejisi ger\u00e7ekten \u00e7ok kuvvetli. \u0130deolojik iklimle birlikte nesil de\u011fi\u015fiyor. B\u00fcy\u00fck Ortado\u011fu Projesi\u2019nin ideolojik y\u00f6n\u00fc olarak \u00fclkemize 1980\u2019de dayat\u0131lan \u201c\u0131l\u0131ml\u0131 \u0130slam projesi\u201dnin sa\u011flad\u0131\u011f\u0131 konjonkt\u00fcrel f\u0131rsat\u0131n topyek\u00fbn iktidar amac\u0131yla de\u011ferlendirildi\u011fini anl\u0131yoruz, fark\u0131nday\u0131z.<\/p>\n\n\n\n<p>Fakat y\u00fcksek makamlardan s\u00f6ylenenlere toplumun geni\u015f kesimi inan\u0131yor.&nbsp; T\u0131pk\u0131 fasulye olay\u0131ndaki gibi. T\u00dcB\u0130TAK\u2019\u0131n (T\u00fcrkiye Bilimsel ve Teknolojik Ara\u015ft\u0131rma Kurumu!) \u00f6d\u00fcllendirdi\u011fi bir projede Kur\u00e2n-\u0131 Kerim dinleyen fasulye, Arabesk-Rap dinleyen fasulyeden \u00fc\u00e7 kat daha h\u0131zl\u0131 b\u00fcy\u00fcm\u00fc\u015ft\u00fc. Yirmi g\u00fcn i\u00e7inde&nbsp; &nbsp;birinci fasulye 31 santimi m\u00fctecaviz bir y\u00fcksekli\u011fe ula\u015f\u0131rken, ikincisi 13 santimde kal\u0131yor. &nbsp;Kurumun ba\u015f\u0131ndaki bilimsel yetkililer, projenin ad\u0131na \u201cCanlar\u0131n g\u0131das\u0131 Kur\u00e2n-\u0131 Kerim\u201d koymu\u015flar ve bu y\u00f6ntemin b\u00fct\u00fcn tar\u0131m alanlar\u0131na uygulanmas\u0131n\u0131 tavsiye ediyorlar. &nbsp;D\u00fc\u015f\u00fcnebiliyor musunuz, bu\u011fday tarlalar\u0131, bostanlar, zeytinlikler, meyve bah\u00e7eleri\u2026<\/p>\n\n\n\n<p>Asl\u0131nda bu gibi y\u00f6ntemler bence fabrikalarda eme\u011fin \u00fcretkenli\u011fini art\u0131rmak ve devlet dairelerinde memurlar\u0131n zihnine k\u00fc\u015f\u00e2yi\u015f (parlakl\u0131k) vermek i\u00e7in de kullan\u0131labilir, \u00fcretim ekonomisinin ve kalk\u0131nman\u0131n motoru olur.<\/p>\n\n\n\n<p>Ben bu t\u00fcrden proje ve s\u00f6ylemlere kar\u015f\u0131 de\u011filim, samimi s\u00f6yl\u00fcyorum. Zira bunlar\u0131n halk kitleleri \u00fczerinde uyand\u0131r\u0131c\u0131 etkisi oldu\u011funa, k\u0131sa s\u00fcrede \u00e7ok olumlu siyas\u00ee sonu\u00e7lar do\u011furaca\u011f\u0131na inan\u0131yorum. Zira bir sosyalist olarak milletimizin \u201cm\u00e2\u015feri \u015fuuru\u201dna (toplumsal vicdan) g\u00fcveniyorum; bu \u00fclkenin kurucu ilkelerinin g\u00fc\u00e7l\u00fc oldu\u011funa, Mustafa Kemal hayranl\u0131\u011f\u0131n\u0131n \u00e7ok derinlere n\u00fcfuz etmi\u015f birle\u015ftirici bir tarihsel anlam ta\u015f\u0131d\u0131\u011f\u0131na inan\u0131yorum.<\/p>\n\n\n\n<p>&nbsp;\u00c7\u0131kars\u0131nlar laikli\u011fi Anayasa\u2019dan! Tutarl\u0131l\u0131\u011f\u0131n ve d\u00fcr\u00fcstl\u00fc\u011f\u00fcn icab\u0131d\u0131r. Siyas\u00ee iktidar\u0131n her g\u00fcn ayaklar\u0131n\u0131n alt\u0131nda \u00e7i\u011fnedi\u011fi bir ilkenin anayasada ne i\u015fi var? B\u00f6ylece kimse kendini aldatmaz, ne yapacaksa yapar.
