Devlet\u2019in rengi de yoktur. Devlet\u2019in durumu \u201cnormal\u201d de\u011fildir.<\/p>\n\n\n\n<p>Neyse, konuyu da\u011f\u0131tmayal\u0131m\u2026<\/p>\n\n\n\n<p>Soyut anlamda Devlet farkl\u0131 s\u0131n\u0131flar\u0131n ve \u00e7\u0131kar gruplar\u0131n\u0131n kuvvet bile\u015fkesidir. Toplumsal s\u0131n\u0131flar aras\u0131ndaki \u00e7eli\u015fmelerin ba\u011fda\u015ft\u0131r\u0131lmas\u0131 ve uzla\u015ft\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 zaman Devlet ihtiyac\u0131 ortaya \u00e7\u0131km\u0131\u015ft\u0131r. Yani toplumsal \u00e7eli\u015fmeler uzla\u015ft\u0131r\u0131labilir olsayd\u0131 ya da hi\u00e7 olmasayd\u0131, Devlet diye bir \u015fey de olmazd\u0131.&nbsp; Devlet mutlak ve sonsuz bir varl\u0131k olmay\u0131p belirli tarihsel ko\u015fullar\u0131n \u00fcr\u00fcn\u00fcd\u00fcr. Ko\u015fullar de\u011fi\u015ftik\u00e7e Devlet de de\u011fi\u015fir; zay\u0131flar, g\u00fc\u00e7lenir, da\u011f\u0131l\u0131r ya da rehin al\u0131n\u0131r, asker\u00ee darbeyle ele ge\u00e7irilir, bir tarikatlar koalisyonu taraf\u0131ndan y\u00f6netilir, mafyala\u015f\u0131r, \u00e7\u00fcr\u00fcr, s\u00f6n\u00fcmlenir. Modern toplumda se\u00e7imle g\u00f6reve gelen h\u00fck\u00fcmet Devlet ayg\u0131t\u0131yla b\u00fct\u00fcnle\u015fmez ya da ayg\u0131t\u0131 ele ge\u00e7irip kendi ideolojik suretinde onu yeniden yaratmaya kalk\u0131\u015fmaz. &nbsp;\u201c\u0130taat skalas\u0131\u201d diye bir \u015fey vard\u0131r. H\u00fck\u00fcmet bu skalada -tabii ki modern demokratik kapitalist toplumda- yasama ve yarg\u0131\u2019n\u0131n alt\u0131nda yer al\u0131r. Bu kurumlar, anayasadan ald\u0131klar\u0131 yetkiyle yurtta\u015flar ad\u0131na h\u00fck\u00fcmeti denetler. H\u00fck\u00fcmet, kanunu ancak teklif edebilir, bizzat kanun \u00e7\u0131karmaz. Kanunu \u00e7\u0131karma g\u00f6revi yasama kurumuna aittir ve \u00e7\u0131kar\u0131lan her kanun Anayasa\u2019ya ve&nbsp; kanunlara uygunlu\u011fu bak\u0131m\u0131ndan yarg\u0131 taraf\u0131ndan denetlenir. H\u00fck\u00fcmet \u00e7\u0131kar\u0131lan kanunu uygulamakla y\u00fck\u00fcml\u00fcd\u00fcr.&nbsp; &nbsp;H\u00fck\u00fcmet gelip ge\u00e7icidir, Devlet\u2019in kurumlar\u0131 kal\u0131c\u0131d\u0131r.<\/p>\n\n\n\n<p>Bunlar\u0131 bize ortaokuldayken yurtta\u015fl\u0131k bilgisi \u00f6\u011fretmenimiz \u0130brahim Bey tane tane anlatm\u0131\u015ft\u0131. Herkesin hat\u0131rlamas\u0131 gerekir.&nbsp; Mevcut duruma al\u0131\u015fmak ve rejimi \u201cnormal\u201d g\u00f6rmek \u00f6l\u00fcmc\u00fcl sonu\u00e7lar do\u011furacakt\u0131r.<\/p>\n\n\n\n<p>Bu a\u00e7\u0131lardan mevcut Devlet\u2019e bakt\u0131\u011f\u0131m\u0131z zaman, bir kere h\u00fck\u00fcmet diye bir yap\u0131n\u0131n olmad\u0131\u011f\u0131n\u0131, bu yap\u0131n\u0131n b\u00fct\u00fcn g\u00f6rev ve sorumluluklar\u0131n\u0131n Saray taraf\u0131ndan devral\u0131nd\u0131\u011f\u0131n\u0131, kanunlar\u0131n Saray ofislerinde dan\u0131\u015fmanlar taraf\u0131ndan haz\u0131rland\u0131\u011f\u0131n\u0131, Cumhurba\u015fkan\u0131\u2019n\u0131n tek ba\u015f\u0131na \u201cola\u011fan\u00fcst\u00fc h\u00e2l\u201de karar verdi\u011fini, yasama g\u00fcc\u00fc ile Saray\u2019\u0131n icra kudreti aras\u0131nda her t\u00fcr\u00fc modern Devlet teorisini \u00e7atlatacak \u00f6l\u00e7\u00fcde bir nisbetsizlik oldu\u011funu g\u00f6r\u00fcyoruz. Mesela bir yasama d\u00f6neminde TBMM\u2019nin 600 milletvekili 1429 kanun teklifini 11 komisyonda tart\u0131\u015farak 100 kadar kanun \u00e7\u0131kar\u0131rken, Reis tek ba\u015f\u0131na kararname \u00e7\u0131kararak 2229 maddeyi gerek\u00e7e g\u00f6stermeden ve denetime tabi olmadan y\u00fcr\u00fcrl\u00fc\u011fe koydu. Yani Devlet, siyas\u00ee iktidar taraf\u0131ndan ele ge\u00e7irilerek yurtta\u015flar\u0131 belirli bir ideolojinin hegemonyas\u0131na tabi k\u0131lamaz. Fakat vak\u0131f paralar\u0131yla semirip rehavete g\u00f6m\u00fclm\u00fc\u015f tarikat erbab\u0131 ile da\u011f\u0131n\u0131k cami cemaatini \u201cMill\u00ee Diktat\u00f6rl\u00fck\u201d idealinde birle\u015ftirerek kusursuz bir fa\u015fist rejim kurmak pek m\u00fcmk\u00fcn g\u00f6r\u00fcnm\u00fcyor.
