Bu bak\u0131mdan Saray d\u00f6nemi \u00e7ok \u00f6\u011fretici oldu.<\/p>\n\n\n\n<p>Yasama g\u00fcc\u00fcn\u00fc ele ge\u00e7iren \u00e7ok dar bir kadronun Devlet\u2019i \u00f6ncekinden tamamen farkl\u0131 bir \u015feye d\u00f6n\u00fc\u015ft\u00fcrebilece\u011fini, kurumlar\u0131n at\u0131klar\u0131n\u0131 plastik madde gibi toplay\u0131p yeniden \u00fcreterek ona istedi\u011fi \u015fekli verebilece\u011fini g\u00f6rd\u00fck.<\/p>\n\n\n\n<p>&nbsp;\u201cOla\u011fan\u00fcst\u00fc h\u00e2l\u201d ilan etme, kanun\/kararname \u00e7\u0131karma yetkisini tek elde toplad\u0131ktan sonra, makam mevki payla\u015ft\u0131rarak, para ve kaynak da\u011f\u0131tarak devleti, XIV. Bu evreyi ge\u00e7tikten sonra acayip derecede demokratik bir anayasa yap\u0131yorum, \u201cMaastricht olmazsa \u0130stanbul kriterlerini ilan eder yolumuza devam ederiz,\u201d \u0130stanbul S\u00f6zle\u015fmesi, \u00c7\u00f6z\u00fcm S\u00fcreci, hemen ard\u0131ndan iri olal\u0131m diri olal\u0131m falan diyerek ve b\u00f6ylece b\u00fct\u00fcn siyas\u00ee toplumu kand\u0131rarak, solcu ya da sa\u011fc\u0131 gibi duran entelijansiyay\u0131 \u00e7e\u015fitli manevralarla ve elbette yine parayla da\u011f\u0131t\u0131p sersemle\u015ftirerek yola devam edebiliyorsunuz.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Burada en \u00f6nemli nokta mevcut Anayasa, Medeni Kanun ve Ceza Kanunu\u2019nun i\u015flemez h\u00e2le getirilmesidir. Devlet\u2019i ele ge\u00e7iren kadro mevcut yasalar\u0131 fiilen y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131rken, toplumun i\u00e7inde ya\u011f lekesi gibi geni\u015fleyen bir kesim, \u00f6rg\u00fctl\u00fc gruplar\u0131n y\u00f6nlendirmesiyle kendi hayat\u0131n\u0131 mevcut anayasa ve yasalara g\u00f6re de\u011fil, din\u00ee dogmalara g\u00f6re yeniden d\u00fczenleyebiliyor; b\u00f6ylece sosyal yap\u0131y\u0131 ve k\u00fclt\u00fcrel dokuyu de\u011fi\u015ftirebiliyor.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;Eski Yarg\u0131tay Onursal Cumhuriyet Ba\u015fsavc\u0131s\u0131 Sabih Kanado\u011flu mevcut durumu \u015f\u00f6yle tan\u0131ml\u0131yor:<\/p>\n\n\n\n<p>\u201cTemel hak ve \u00f6zg\u00fcrl\u00fckler Anayasam\u0131zda gayet net, a\u00e7\u0131k bir \u015fekilde g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Ancak, laik, demokratik, sosyal bir hukuk devleti oldu\u011fu s\u00f6ylenen T\u00fcrkiye bug\u00fcn ne laiktir, ne demokratiktir, ne sosyal devlettir, ne de hukuk devletidir. O halde, e\u011fer kanunlar vas\u0131tas\u0131yla bu temel hak ve \u00f6zg\u00fcrl\u00fckler uygulanam\u0131yor ise, bir kanun devleti haline d\u00f6nmemiz m\u00fcmk\u00fcnd\u00fcr, ancak T\u00fcrkiye bug\u00fcn, kanunlar\u0131n dahi uygulanmad\u0131\u011f\u0131 bir \u00fclke halindedir. O halde bug\u00fcn \u00e7ok net bir \u015fekilde ifade edebiliriz ki T\u00fcrkiye ne anayasal devlettir, ne kanun devletidir. T\u00fcrkiye bug\u00fcn kelimenin tam anlam\u0131yla bir polis devletidir&#8230;&#8221; (08.02. 22)<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Burada ortaya san\u0131r\u0131m me\u015fruiyet sorunu \u00e7\u0131k\u0131yor.<\/p>\n\n\n\n<p>Siyas\u00ee iktidar se\u00e7im kazanarak ve kanun\/kararname \u00e7\u0131kararak toplumun \u201cma\u015feri \u015fuur\u201dunda (vicdan\u0131nda) me\u015fruluk edinemiyor. Toplumsal \u00e7o\u011funlu\u011fun uygun buldu\u011fu, raz\u0131 oldu\u011fu \u015fey me\u015frudur. N\u00fcfusun yar\u0131s\u0131 siyas\u00ee iktidar\u0131n yapt\u0131klar\u0131n\u0131 uygun bulmuyor ve r\u0131za g\u00f6stermiyorsa, ortada me\u015fruiyet yoktur.<\/p>\n\n\n\n<p>Evrensel hukuk, \u0130nsan ve Yurtta\u015f Haklar\u0131 Bildirgesi\u2019nden (A\u011fustos 1789) bu yana egemenli\u011fin esas\u0131n\u0131n millete dayal\u0131 oldu\u011funu, mutlak egemenli\u011fin bir ki\u015fi ya da grubun elinde bulunamayaca\u011f\u0131n\u0131, devleti idare edenlerin esas olarak millete kar\u015f\u0131 sorumlu oldu\u011funu, hi\u00e7 kimsenin din\u00ee ve sosyal inan\u00e7lar\u0131 y\u00fcz\u00fcnden k\u0131nanamayaca\u011f\u0131n\u0131, aksi h\u00e2lde halk\u0131n direnme hakk\u0131n\u0131n do\u011faca\u011f\u0131n\u0131 kabul etmi\u015ftir. &nbsp;Yasalar\u0131n siyas\u00ee iktidar taraf\u0131ndan g\u00f6z g\u00f6re g\u00f6re ihlal edilmesi de halk\u0131n direni\u015fine me\u015fruluk kazand\u0131r\u0131r.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Mesela AKP Grup Ba\u015fkanvekili\u2019nin devlet protokol\u00fcnde&nbsp; Anayasa Mahkemesi, Yarg\u0131tay ve Dan\u0131\u015ftay ba\u015fkanlar\u0131n\u0131n \u00f6n\u00fcne ge\u00e7irilmesi &nbsp;kanunsuzdur ve bir skandald\u0131r. Diyanet \u0130\u015fleri Ba\u015fkan\u0131\u2019n\u0131n 40. s\u0131radan 12. s\u0131raya y\u00fckseltilerek genel kurmay ba\u015fkan\u0131 ve kuvvet komutanlar\u0131n\u0131n \u00f6n\u00fcne ge\u00e7irilmesi ne Anayasa\u2019ya, ne kanuna kitaba, ne de T\u00fcrkiye Cumhuriyeti\u2019nin devlet team\u00fcllerine uygundur. Dolay\u0131s\u0131yla me\u015fru de\u011fildir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Buna devlet ricali, hukuk\u00e7ular ve halk olarak kar\u015f\u0131 \u00e7\u0131km\u0131yorsan\u0131z, Diyanet Ba\u015fkan\u0131\u2019n\u0131n sar\u0131\u011f\u0131 ve c\u00fcbbesiyle (\u015fimdilik elinde k\u0131l\u0131c\u0131 olmadan) asker\u00ee birli\u011fi denetlemesini, t\u00f6ren k\u0131tas\u0131n\u0131 selamlay\u0131p askerden tekmil almas\u0131n\u0131 da do\u011fal kar\u015f\u0131lars\u0131n\u0131z. Bu durumda \u00c7orum valisinin \u0130skilipli At\u0131f\u2019\u0131n mezar\u0131 ba\u015f\u0131nda ihtiram duru\u015funda bulunmas\u0131na ya da t\u00fcmen komutan\u0131n\u0131n kendisini ziyarete gelen bakanlara \u201cgeli\u015finizi hissettik sayg\u0131de\u011fer efendimiz, sevin\u00e7ten t\u00fcylerimiz diken diken oldu\u201d mealinde iltifat etmesine de ses \u00e7\u0131karmazs\u0131n\u0131z.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; B\u00fct\u00fcn bunlar bir yana, Devlet\u2019in plastik bir madde gibi nas\u0131l d\u00f6n\u00fc\u015ft\u00fcr\u00fcld\u00fc\u011f\u00fcn\u00fc ve hem yukar\u0131dakilerin hem de a\u015fa\u011f\u0131dakilerin buna nas\u0131l raz\u0131 olabildiklerini h\u00e2l\u00e2 anlayabilmi\u015f de\u011filim.
