{"id":1010,"date":"2022-01-21T09:36:08","date_gmt":"2022-01-21T07:36:08","guid":{"rendered":"http:\/\/yavuzalogan.com\/?p=1010"},"modified":"2022-01-21T09:36:08","modified_gmt":"2022-01-21T07:36:08","slug":"iyi-uykular-turkiye","status":"publish","type":"post","link":"http:\/\/yavuzalogan.com\/?p=1010","title":{"rendered":"\u0130Y\u0130 UYKULAR T\u00dcRK\u0130YE"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"702\" height=\"336\" src=\"http:\/\/yavuzalogan.com\/wp-content\/uploads\/2022\/01\/Horoz.jpg\" alt=\"\" class=\"wp-image-1011\" srcset=\"http:\/\/yavuzalogan.com\/wp-content\/uploads\/2022\/01\/Horoz.jpg 702w, http:\/\/yavuzalogan.com\/wp-content\/uploads\/2022\/01\/Horoz-500x239.jpg 500w\" sizes=\"auto, (max-width: 702px) 100vw, 702px\" \/><\/figure>\n\n\n\n<p>Yavuz Alogan<\/p>\n\n\n\n<p><a>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; D\u00fc\u015f\u00fck yo\u011funluklu ideolojik hegemonya sonsuza kadar s\u00fcrmez; bir evrede mutlaka siyas\u00ee hegemonyaya d\u00f6n\u00fc\u015f\u00fcr.<\/a><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u0130deolojik hegemonyan\u0131n d\u00fc\u015f\u00fck yo\u011funluklu olmas\u0131n\u0131n sebebi, hegemonik g\u00fcc\u00fcn ba\u015fta anayasa olmak \u00fczere b\u00fct\u00fcn yasalar\u0131 mutlak iktidar\u0131n\u0131 kuracak \u015fekilde yeniden yazamam\u0131\u015f olmas\u0131d\u0131r.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Eski rejimin yasalar\u0131 y\u00fcr\u00fcrl\u00fcktedir.<\/p>\n\n\n\n<p>Fakat Devlet\u2019i ele ge\u00e7iren ve her t\u00fcrl\u00fc yasal denetim imk\u00e2n\u0131n\u0131 ortadan kald\u0131ran siyas\u00ee iktidar, ba\u015fta anayasa olmak \u00fczere b\u00fct\u00fcn yasalar\u0131n s\u00fcrekli bi\u00e7imde ihlal edilmesini g\u00f6rmezden gelmekte, hatta elinde toplad\u0131\u011f\u0131 y\u00fcr\u00fctme g\u00fcc\u00fcn\u00fc kullanarak onlar\u0131 bizzat ihl\u00e2l etmektedir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Siyas\u00ee iktidar, Anayasa Yarg\u0131s\u0131\u2019n\u0131 (Anayasa Mahkemesi), Adl\u00ee Yarg\u0131\u2019y\u0131 (Yarg\u0131tay), \u0130dar\u00ee Yarg\u0131\u2019y\u0131&nbsp; (Dan\u0131\u015ftay), Uyu\u015fmazl\u0131k Yarg\u0131s\u0131\u2019n\u0131 (Uyu\u015fmazl\u0131k Mahkemesi) ve Se\u00e7im Yarg\u0131s\u0131\u2019n\u0131 (Y\u00fcksek Se\u00e7im Kurulu)&nbsp; denetim alt\u0131na al\u0131p, &nbsp;bu kurumlar\u0131n y\u00f6netim kademelerini ideolojik olarak kendisine ba\u011fl\u0131 kadro ve militanlarla doldurdu\u011fu zaman, ba\u015fta anayasa olmak \u00fczere eski rejimin yasalar\u0131 &nbsp;etkisini ve g\u00fcc\u00fcn\u00fc kaybeder.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Bu durumda, Anayasa\u2019da yaz\u0131l\u0131 olan laiklik ilkesini herkes ihl\u00e2l edebilir, isteyen hilafeti savunabilir ya da insanlar\u0131n hayat tarz\u0131na m\u00fcdahale etme hakk\u0131n\u0131 kendinde bulabilir.<\/p>\n\n\n\n<p>Meden\u00ee Kanun y\u00fcr\u00fcrl\u00fcktedir fakat toplumun bir kesiminde alenen \u015feriat hukuku uygulanmaktad\u0131r. Ba\u015fta Diyanet olmak \u00fczere b\u00fct\u00fcn din\u00ee kurumlar kendi cemaatlerine ve \u00fcmmet olarak g\u00f6rd\u00fckleri topluma hitap eden fetvalarla sosyal hayat\u0131 aileden ba\u015flayarak d\u00fczenlemektedir. Ticaret Kanunu da y\u00fcr\u00fcrl\u00fcktedir fakat iktisad\u00ee hayat\u0131n i\u00e7ine&nbsp;&nbsp; \u0130slam f\u0131kh\u0131nda yer alan, yasa h\u00fckm\u00fcnde kesin kurallar (\u201cnasslar\u201d) &nbsp;girmi\u015ftir. Eski rejimin Ceza Kanunu ve Ceza Muhakemeleri Usul\u00fc Kanunu da y\u00fcr\u00fcrl\u00fcktedir fakat iktidar bloku g\u00f6zda\u011f\u0131 vermek ya da intikam almak i\u00e7in kendi savc\u0131lar\u0131na diledi\u011fi gibi iddianame yazd\u0131rarak 80 ya\u015f\u0131ndaki generali cezaevine koyabilmekte, isnat edilen su\u00e7lar\u0131 i\u015fledi\u011fine dair tek bir somut delil g\u00f6sterilemeyen adam\u0131 d\u00f6rt y\u0131l tutuklu olarak tutabilmektedir.<\/p>\n\n\n\n<p>Ve bu tuhaf durum ne siyas\u00ee parti y\u00f6netimlerinin, ne b\u00fcrokrasinin ne de birka\u00e7 istisna d\u0131\u015f\u0131nda hukuk\u00e7ular\u0131n isyan\u0131na yol a\u00e7maktad\u0131r.<\/p>\n\n\n\n<p>Pe\u015finize Gestapo mu takt\u0131lar? Neden korkuyorsunuz?<\/p>\n\n\n\n<p>Korkulacak bir \u015fey yokken kimsenin sesini \u00e7\u0131karmamas\u0131 ideolojik hegemonyan\u0131n g\u00f6stergesidir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Demek ki hukuk, biri yaz\u0131l\u0131, di\u011feri fiili olmak \u00fczere ikiye b\u00f6l\u00fcnm\u00fc\u015ft\u00fcr. Siyas\u00ee iktidar bu fiili hukuku yaz\u0131l\u0131 hukuka d\u00f6n\u00fc\u015ft\u00fcrd\u00fc\u011f\u00fc anda mutlak h\u00e2kimiyetini sa\u011flam\u0131\u015f, topluma dayatt\u0131\u011f\u0131 ideolojik hegemonya siyas\u00ee hegemonyaya d\u00f6n\u00fc\u015fm\u00fc\u015f olacakt\u0131r. Ondan sonras\u0131 \u00e7ok zordur. &nbsp;&nbsp;<\/p>\n\n\n\n<p>\u015eu anda ya\u015fad\u0131\u011f\u0131m\u0131z bir ge\u00e7i\u015f evresidir. Yirmi y\u0131l s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>Ge\u00e7i\u015f s\u00fcrecinin iki d\u00f6n\u00fcm noktas\u0131, 2007 ve 2017 Anayasa referandumlar\u0131d\u0131r. Birinci referandumda halka \u201cCumhurba\u015fkan\u0131 meclis taraf\u0131ndan de\u011fil halk taraf\u0131ndan se\u00e7ilsin mi?\u201d diye; ikinci referandumda ise \u201cParlamenter sistem kald\u0131r\u0131larak y\u00fcr\u00fctme yetkisi partili cumhurba\u015fkan\u0131na verilsin mi?\u201d diye sorulmu\u015ftur. &nbsp;Referandum s\u00fcrecinde ba\u015flat\u0131lan mill\u00ee anayasa hareketi, i\u00e7eriden bilin\u00e7li bir tutumla b\u00f6l\u00fcnerek fel\u00e7 edilmi\u015f, b\u00f6ylece toplumun&nbsp;&nbsp; ayd\u0131nlanmas\u0131 \u00f6nlenmi\u015ftir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Siyas\u00ee toplum bu referandumlar\u0131n muhtemel sonu\u00e7lar\u0131n\u0131 \u00f6ng\u00f6rememi\u015f ya da anlamazl\u0131ktan gelmi\u015f, siyas\u00ee \u0130slam\u2019\u0131n ideolojik hegemonyas\u0131na boyun e\u011fmeye haz\u0131r oldu\u011funu g\u00f6stermi\u015ftir. En \u00f6nde ana muhalefet partisi olmak \u00fczere belli ba\u015fl\u0131 b\u00fct\u00fcn siyas\u00ee partilerin, ba\u015fta laiklik ilkesi olmak \u00fczere Cumhuriyet Devrimi\u2019nin kazan\u0131mlar\u0131n\u0131 savunmaktan \u00f6zellikle ka\u00e7\u0131nmalar\u0131; se\u00e7meni etkilemek i\u00e7in \u201cyurtta\u015fl\u0131k haklar\u0131\u201d yerine \u201ckul haklar\u0131\u201dndan s\u00f6z etmeleri;&nbsp; ba\u015fta sendikalar olmak \u00fczere kitle \u00f6rg\u00fctlerini,&nbsp; emek\u00e7i yurtta\u015f\u0131n hak arama m\u00fccadelesini, \u00f6rg\u00fctl\u00fc toplumu savunacak yerde \u201cfakir-fukara-garip-guraba\u201d edebiyat\u0131na katk\u0131da bulunmalar\u0131; \u00f6zetle, din\u00ee referanslar\u0131 \u00e7a\u011fr\u0131\u015ft\u0131ran s\u00f6zlerle&nbsp; Saray\u2019\u0131n jargonunu taklit etmeleri, ideolojik hegemonyan\u0131n bir di\u011fer g\u00f6stergesidir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; B\u00fcy\u00fck Kalk\u0131\u015fma 24 Temmuz 2020 g\u00fcn\u00fc Ayasofya\u2019n\u0131n ibadete a\u00e7\u0131lmas\u0131yla ba\u015flam\u0131\u015ft\u0131r. T\u00fcrk Ayd\u0131nlanmas\u0131\u2019n\u0131n ba\u015flang\u0131c\u0131 olan 24 Temmuz (1908, II. Me\u015frutiyet\u2019in ilan\u0131 ve Kanun-\u0131 Es\u00e2si\u2019nin y\u00fcr\u00fcrl\u00fc\u011fe girmesi) g\u00fcn\u00fcne denk getirilen bu a\u00e7\u0131l\u0131\u015f t\u00f6reniyle b\u00fct\u00fcn d\u00fcnyaya Cumhuriyet Devrimi\u2019yle hesapla\u015fman\u0131n tamamland\u0131\u011f\u0131 ilan edilmi\u015f, namaz saf\u0131nda toplanan devlet ric\u00e2linin kar\u015f\u0131s\u0131na elinde k\u0131l\u0131\u00e7la \u00e7\u0131kan Diyanet \u0130\u015fleri Ba\u015fkan\u0131 Cumhuriyet\u2019i kuranlara lanet okumu\u015ftur. Namaz\u0131 ve hutbeyi m\u00fcteakiben Genel Kurmay Ba\u015fkan\u0131, Nur Cemaati\u2019nin lideriyle caminin i\u00e7inde foto\u011fraf \u00e7ektirmi\u015f, b\u00f6ylece Mahmut \u015eevket Pa\u015fa ile Dervi\u015f Vahdeti yan yana duruyormu\u015f gibi tuhaf bir manzara olu\u015fmu\u015ftur.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Siyas\u00ee toplum, bu \u201cB\u00fcy\u00fck Kalk\u0131\u015fma\u201dy\u0131 ola\u011fan kar\u015f\u0131lam\u0131\u015f, tarih bilincinden tamamen yoksun siyaset esnaf\u0131, kamuoyu yoklamalar\u0131na g\u00f6nderme yaparak, Ayasofya\u2019n\u0131n ibadete a\u00e7\u0131lmas\u0131n\u0131n AKP\u2019nin oy oran\u0131nda bir art\u0131\u015fa yol a\u00e7mad\u0131\u011f\u0131n\u0131 s\u00f6ylemi\u015f, b\u00f6ylece y\u00fcreklere su serpmi\u015ftir!<\/p>\n\n\n\n<p>Siyas\u00eeler bu \u201cB\u00fcy\u00fck Kalk\u0131\u015fma\u201dy\u0131 anlamam\u0131\u015flar, anlad\u0131larsa da i\u00e7lerine sindirebilmi\u015fler, hatta \u201cyanl\u0131\u015f anla\u015f\u0131lma\u201d korkusuyla ona k\u0131y\u0131s\u0131ndan k\u00f6\u015fesinden i\u015ftirak etmi\u015flerdir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u0130ddia edildi\u011fi gibi ta\u00e7 giyen ba\u015f ak\u0131llanm\u0131\u015f m\u0131d\u0131r?<\/p>\n\n\n\n<p>G\u00fc\u00e7l\u00fc ideolojik y\u00f6nelimleri olmayan, kendi \u00fclkesinin tarihine, yaz\u0131l\u0131 hukukuna sayg\u0131l\u0131, halk\u0131na merhametli ortalama bir ba\u015f, ta\u00e7 giyince elbette ak\u0131llan\u0131r. &nbsp;Fakat y\u00fcz y\u0131ll\u0131k tarihle hesapla\u015farak ideolojik hegemonya kurmaya, \u00fclkenin saatini geriye do\u011fru \u00e7al\u0131\u015ft\u0131rmaya kararl\u0131, her ad\u0131m\u0131nda bir sonraki ad\u0131m\u0131n\u0131 gizleyen biri, akl\u0131n\u0131 farkl\u0131 bi\u00e7imde kullanacakt\u0131r. Bu durumda ba\u015f ile ta\u00e7 b\u00fct\u00fcnle\u015fir, birbirinden ayr\u0131lamaz. \u0130\u00e7 ve d\u0131\u015f konjonkt\u00fcr\u00fc elveri\u015fli buldu\u011fu anda kendi iktidar\u0131 i\u00e7in tehlikeli g\u00f6rd\u00fc\u011f\u00fc ba\u015flar\u0131 kesip atacakt\u0131r.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp; B\u00fct\u00fcn kazan\u0131mlar\u0131yla birlikte Cumhuriyet Ayd\u0131nlanmas\u0131\u2019n\u0131n i\u015fi bir se\u00e7ime ve bir referanduma kalm\u0131\u015ft\u0131r.
